Can a Will be Challenged if Another Person Encouraged the Preparation?


Speaker 1: That depends upon the circumstances. If that other person was a family member or friend who just wanted to make sure that this person had the proper documents in place and they were not telling them what to do, then that's okay. However, if someone comes in to my office and sits down with another individual and starts talking to me about what that person wants, that person has to leave the room. I have to be certain that this is the decision of my client and that nobody is exerting any undo influence upon them to make decisions that would benefit maybe that other person.
